I was in the same situation as the OP. I am 2-1/2 years behind on my HOA dues because the lender still has not foreclosed. so I personally filed a Quit Claim Deed with the florida county clerk deeding the home to DH after my BK discharge. The clerk registered it as a Quit Claim for $20 and my name was taken off the deed. Dont know what may happen in the future but for now the HOA bills only have DH's name on them.

Yes, no house payments, no HOA payments for 2-1/2 years so far. Still no foreclosure. I finally qualified for a USDA mortgage and purchased another house in March 2009. So Im going to rent the other house out as a pre-foreclosure home on a month to month basis until its gone. The Lenders attorney moved twice for summary judgment but I filed my BK7 right before the hearing and then DH filed before the 2nd hearing. So its taking a little longer to foreclose. Yes you will have to wait a long time. Life stinks and so does this Chapter 7 and surrendering your home process. I have not made a payment since December of 08, and it was a partial payment. I have informed them by phone and online that I have moved out in May. Both times they stated they would note my account and thats it. Still no foreclosure. I told them I would send a certified letter, but they basically said "What is that going to do? We already noted your account." So however long they take, we are stuck paying HOAs. Last year they started foreclosure proceedings after the 4th month of non-payment. This year it has been 7 months and nothing.

Im not sure about Colorado foreclosures but in Florida it always goes through the courts. So I did everything I could think of to hang on to the house until I could get a new house.
