I am very confused. I filed Chapter 13 on 7/30/2010 and was confirmed on 1/18/2011. I live in Florida.
BOA has just notified me that they are starting foreclosure procedures. I am 2 months behind.
I pay my mortgage directly to BOA. I am getting conflicting stories from my attorney and the bank. The bank says when my BK was confirmed, they have an agreement for me to surrender the home. My attorney says no agreement exists. My attorney also said that because my mortgage is paid outside the plan and directly to BOA, the stay was lifted when the plan was confirmed in January. I can't get a consistent story from anyone. Any comments are greatly appreciated.
