This is my first time posting. My husband and I filed in April 2025 with me filing Ch. 7 and him filing Ch. 13. We were able to file in this manner due to living in separate homes with separate incomes, bank accounts, etc. At the time of filing in April, my husbands income was above the median and he didn’t qualify for a Ch. 7. We both had our 341 hearings on the initial filing in June 2025. Mine went fine. His, not so much. His trustee was questioning the income calcuations, exemptions, just everything. His trustee later filed objections to both his Ch. 13 payment calculation because he said he felt he could ‘pay more’ and filed objection to the exemptions, citing that they were above allowable limits.
In the meantime, circumstances changed for my husband with regards to income and expenses, which allowed him to qualify for Ch. 7. The attorney converted from 13 to 7 at the end of June 2025. My husband had his new 341 hearing on August 7, 2025, and it went perfect. The trustee asked the basic questions to confirm the information in the petition and released him from the hearing. My husband’s case was discharged on 10-07-2025; however the trustee still hasn’t filed a report of no distribution, so the case remains open. We have heard nothing from his trustee since the 341 hearing in August. Meanwhile, my case discharged and closed with no issues.
I have reached out to our attorney a couple of times since August asking if he has heard anything from the trustee and he says that he has not heard a thing. He finally told me today that he would reach out to the trustee and ask her what the status is. I guess I’m just looking for someone with similar experiences that can calm my anxiety over this. Why would he be 30+ days post discharge and still no report filed by the trustee? Can she (the trustee) still object to exemptions? Income? Etc.? I just feel it’s strange that if she had an issue or found assets to liquidate that she hasn’t reached out with additional questions or requests.
