    Allowable expenditures before filing

    Hello
I am in the process of filing for bankruptcy and have a question about what I am allowed to spend the proceeds from selling a timeshare on. My attorney said home repairs are ok, and my phone is over 10 years old and no longer working properly so that would be ok too. Are there any other suggestions that I can use so that I don’t have to give any of that away to debtors? Thank you in advance. For background, I’m still paying off my daughter’s student loan as a parent plus loan, and have around $100k in credit card debt with no savings and living only on a pension.

How much were the proceeds from the time share? Hopefully it's not enough to cover the $100,000 and the Parent Plus Loan. My gut feels like that might be questioned if you chose to buy other things, even if needed instead of paying the creditors.

If your lawyer says it is ok to spend then it should be ok.

You can ask for more clarification, but buying a new to you car that will last 5 yrs without major repairs is good to have prior to filing Chapter 13. If your current car is likely to kick the bucket within 5 yrs buy a decent non-luxury used car. You do not want to buy a luxury or brand new car. Like anything else check with your lawyer and do not take any internet advice as 100% accurate because things vary over time and vary district to district

I wish you well on your BK journey
I am not an expert. I share my experiences in the Wonderful Wacky World of Chapter 13! Filed 3-30-18 Confirmed 7-11-18 Discharged 6-8-22
