I am in the process of a foreclosure and will be filing my chapter 7 bankruptcy the first week in december. I have found an apartment and paid the first months rent, as my BK lawyer had told me that once I surrender my home in the BK, i will need a place to live and I was fearful that with a BK or foreclosure, nobody would rent to me after I filed. The reason for my BK is because I squandered my income on foolish things such as a vacation for me & my daughter 2 yrs ago when i thought I was dying (turned out to be OCD & anxiety disorder) and a gambling addiction (also related to the OCD & anxiety disorder) and everything snowballed and I was unable to pay the amounts needed to get my home out of foreclosure and my CC up to date. I have SOOO learned my lesson and I am on a GA website that is extremely helpful to me.
My question is, am I allowed to move out before the BK is filed or will this cause the trustee to question my chapter 7 filing? I just want this to be over with and get on with our lives in a new place and leave this all behind! I am JUST under the median income (by about $400) in NY state and I really want this to go smoothly and start fresh again.
