    How can I file for Bankruptcy?

    Ok I have a question. I'm an American citizen that is up to $100,000 in US debt. I want to file Chapter 13, but the problem is that I don't live in the US anymore. I recently moved to Canada in May. How do I file for US bankruptcy from Canada?

    How recently did you move?

    Basically, you would file where you last lived in the U.S. But you would have to make a trip or two back to make the required appearances.

      I moved to Canada on May 18 from Passaic, NJ. So I'm guessing I would have to go back to New Jersey and hire a lawyer there and then file? Do I have to file in Passaic, or anywhere in the state?

      However, you could make some inqueries about lawyers and get their advice about how to proceed specifically, you don't really need to meet with the attorney in person. But you would need to go to New Jersey to attend the required 341 Meeting of Creditors.

        Looks like New Jersey is a single Federal District (the District of New Jersey) so you could file anywhere in the state.
