    After you file Bk, do they watch your accounts?

    Hi,

    I'm about to file for Chapter 7 on Friday. I'm expecting to get a nice bonus in mid April. I'm not sure how the process works and how much money I should keep in my account until my hearing, or do they watch you until it's discharged? Anyone know? Would they take that bonus away?? Thanks

    Your Attorney will explain all the details. No one here can say exactly what the Trustee will do. He is after your money and works on behalf of his wallet and your creditors.

      I agree, you have no idea what the trustee will do, or when he will do it. They will check your bank accounts, as they did mine. I got screwed because he happened to check my account on a pay-day Friday, just after the money cleared into my account but before I could spend the money on bills. So that day there was too much money in the account and we ended up having to give up $700. If your boss knows about your situation, maybe you can tell him to hold off on any extra cash until you get your discharge. I am sure he won't mind floating the money for a while. Otherwise, if you get the money, spend it quick on something spendable like food and housewares. The trustee wont argue so much with a big grocery bill as you can always say your cupboard was bare. Just stay away from keeping the cash or buying big ticket items like that new Ipod or Plasma screen.

        If you do have cash at time of filing, say direct deposit, pay your bills by check the day before. Keep copies of the checks and send them with the statements showing that in reality you had no money. I had around 8-900.00 in my account, but i also showed that the checks had been written. BETTER NOT TO HAVE IT IN THE BANK THOUGH!!!! And remember, no cash withdrawals over $50.00 or so dollars unless you keep a reciept showing that you paid something necessary.
