    Property Tax ?

    I'm curious to know how the property tax is handled when my home is basically awaiting the foreclosure process? I filed ch.7 back in Oct.06, had the 341 meeting 12/15/06. I havent made a house payment since Sept or Oct.2006, over 6 months ago. I'm basically just waiting on my discharge and for the Mortgage company to keep procedding with the foreclosure process. I paid my Property tax and homeowners insurance through an escrow acount each month. Will I end up having to pay the tax out of my pocket for 2006?

    Does anyone have any input at all for my question regarding property tax. I have tried to search the threads and I didnt notice anything that seems to answer my question. I did read where someone mentioned that once you surrender the house in BK that you are not liable for any extra expenses. I agreed to let my home go back when I filed ch7 back last year. I do still have insurance on the home and the power is still in my name. Over the weekend I went by my house and noticed that someone had been out and taped a "Notice of hearing" letter on the front door. It tells me that a hearing is set for April 16th and if I dont come fourth to try and resolve the debt the forclosure will go through and there will be a Sale on May 7th. So it looks like the end is in sight. I just hope it doesnt drag out to long and I get hit with a tax bill. Hope someone has some input!!

      Forclosure can not proceed without paying taxes first. Lender will/must pay taxes if house sold to be free/clear of title. Don't worry, just let lender do their things.

        I don't really know, JPOP.

        When we were Consulting around, all the attnys made sure to tell us to keep liability insurance on our house. That we would be responsible for a "slip and fall" injury or whatever happened as long as the Title was still in our names. But no one said a word about taxes.

        Then we got lucky to sell the house and dodge Foreclosure. At closing, we were responsible for the taxes up to the date of the sale.

        Honestly, I don't know what to tell you.

        Most likely, the Lender will be the winning bidder at the auction. The Lender will definitely have to pay the taxes to transfer a clean title. Could be, the Lender will just roll the taxes into their costs??!!

          Thanks for the reply BKOnce & Sinking fast. I guess I will just sit back and not worry about it for now. You sure do learn to practice patients through this process. Thanks again.

            When we decided to file and told the attorney we were letting our rental go back to the lender, he said call them and tell them you're abandoning the property pronto. So I did and was transferred to the bankruptcy dept. I talked with a VERY nice woman who happened to be the one in charge of all the abandoned property. She had me fax her copies of delinquent taxes and she told me they would pay them. I haven't heard a word, nor have I gotten anything from the county. The house was to go delinquent on taxes on the 7th of March, so I guess they paid them?
