i filled out a 1096 on my 10th year in business on 1/29/03 and mailed it then. the irs showed me a copy of the return with the irs date stamp of 3/20/03 which is 20 days past the deadline of 2/28/03. they are imposing a $900.00 penalty plus interest unless i can show proof of a mailing receipt i don't have. shouldn't they have the original envelope? i need help with a letter so i'm asking for any ideas besides getting an atty to write it on where i can look for some help on the internet with this.

I work for the IRS and we do keep the envelope with the mailed receipt date. Request verification of envelope. If they have lost it request an abatement of the interest and penalty due to reasonable cause. If they on the other hand do have it and the post office is the one who caused the delay, they (the Post Office) should have notified you of that as well. But this is one of the hundreds of examples of why all returns and payments should be made by electronic means so that you have verification within 24 hours. Hope this helps you.
