    What if the debt by divorce becomes not dischargable???

    Ok, I am really stunned right now. I was following up on another thread where a poster said debts arising from a divorce are not dischargable.

    I am way under the median and I have no assets as is. What are my options at this point?

    Last year when I went to credit counseling to see if I could consolidate, the person didn't even try to sell me on a plan and told to head straight for bankruptcy attorney.

    I do want to ad that I am not the one paying child support.

    Please HELP! I feel like I'm going to faint.

    What that means is that any depts that you are responsible for because of a divorce decree cannot be discharged.
    Say if the decree ordered that you were responsible for half the house payment, then you couldn't discharge that in BK.
    Same for things like back child support or alimony.

    What exactly are you worried about?

      I was interpreting the settlement agreement as I cannot file for bk regardless. I understand that if I had to (which I don't) pay child support or alimony, those things could not be discharged.

      I just wanted to find out what other options exist if divorce debt is not dischargable and I cannot pay it either.

      I'm sure I'm not setting any precedence.

          Over $70k worth of attorney fees and related. There's probably less than $5k worth of things like gas, groceries, living expenses in general. Though I was recently planning to use a cc to pay for some home repairs that might cost around $1200.

          I tried to get ahold of a bk attorney today, but he was very busy every time I called.

            Well, since the attorney's fees are part of the divorce decree and specifically related to the divorce, they are probably not dischargeable. (i.e. I assume the court is ordering you to pay your ex-spouse's attorney's fees, or are you talking about your own attorney's fees, if it's your ex-spouses fees, they are probably nondischargeable, if they are your fees, you can probably discharge them.).
