You need to get in touch with your attorney immediately over this. Most loan companies (home and auto) will put you into their default or bankruptcy department when you file. That's the department you need to talk to someone in, not the regular customer service number they cannot help you. There have been some on this board have problems with Chase home mortgage not posting payments and such.
You need to contact the default department of Chase home mortgage, explain to them what's happened and make sure you have the default/bk address where payments are to be sent. Send your payments to that address certified return receipt. So YOU have a signed form of when they receive the payment. You need to learn to leave a paper trail for yourself. This is assuming you can get the mistake that has happened corrected.
From my understanding they cannot foreclose on you without requestiong a "lift of automatic stay" from the court. You would have been notified if this occured. If you do lose your home during your bk it would "hit" your CR's at one time, so it would be much better than having it hit them as a seperate bk and then a foreclosure. If you plan on keeping your home, you need to get on the ball and get those payments made up (if they haven't been) fast. Either way you need to follow up on this quickly and get it under control before you lose your home when you don't want to."Try to save money. Someday it may be valuable again." - Anonymous

Try what bktango suggested and see if you can get someone at Chase to talk to you, if they won't contact your lawyer and let him/her know whats going on and that chase won't accept your payment or talk with you and then he/she can find out where to send payment for you.
I had a similar situation (although it was'nt chase) where the company absolutely refused to talk with me, because of the automatic stay, until I signed the reaffirmation papers. All I wanted to know was where to send the payment and they actually sounded scared to even be on the phone with me!chap 7 discharge 06/07

Contact your attorney and do it NOW................ he is responsible for helping you file the re-affirm papers that have to be signed by the judge......
Have money in hand and be prepared to have all payments caught up immediately....
Don't let this go................. especially if you intend to keep you home...Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

I did contact the Chase BK department and they would not talk to me they only could advise me on their lawyers name and address. Do you know the answer to this? If I give up my house during BK does it appear as a foreclosure on my CR? I am told that a foreclosure is worst than a BK on the CR?

I honestly couldn't answer whether it will show up as a Foreclosure or simply say IIB (included in bankruptcy). Maybe someone can come along and answer that for you.
Chase giving you their lawyers name and address was probably so you could reaffirm the loan and send it to their attorney. Our lender had done the same (had us send the paperwork to their attorney). If you want to keep your home, please contact your attorney and let them know what is going on and give them the name of the attorney for Chase so this can get resolved. But since you keep asking about giving up your home and how if effects your cr's I guess you need to sit down first and figure out if you really want to keep it or not. If you decide not to, then let your attorney know you will be surrendering your home."Try to save money. Someday it may be valuable again." - Anonymous

I really appricate you responding thanks to all.... The reason I keep asking is Chase sold my loan to a company called Litton Loan servicing in TX. And based on what I have heard and read about them I am assuming the worst. Basically they like to foreclose on loans (can't figure that one out). So my plan was to include it and just start over. Otherwise I would love to stay in my house seeing as I have spent the last 5 years remodeling it from top to bottom.Originally posted by BKTango View PostI honestly couldn't answer whether it will show up as a Foreclosure or simply say IIB (included in bankruptcy). If Litton Loan bought out your mortgage then you need to contact them and arrange to make the payments to that company. Also find out why you haven't been informed they purchased your loan, you should have received some sort of paperwork on that. After you contact Chase and find out if Litton does hold your mortgage now, then let your lawyer be aware that your mortgage lender changed and you need to reaffirm with them if you choose to do so. It seems like what happened to us, right in the middle of our bk, when we sent out the reaffirm papers our mortgage was bought out. Really is does add to some confusion but if you take care of everything now it should end up being under control and everything will be fine. First things first, find out where your mortgage is so you can send payments."Try to save money. Someday it may be valuable again." - Anonymous
