    HELP!!! 2002 Illinois State Tax Debt

    OK, I'm really stressing here. I filed Chapter 7 in 11/06 and was discharged and closed 03/07. I just received a letter from a collection agency stating they are working for the Illinois Revenue Dept and that i owe $1158.99 in taxes, interest, and collection fees from a 2002 tax return. I am looking at my tax return and the amount owed was $15 for 2002.
    So I go to the Illinois Revenue website and it says there was an error on my 2002 return. So I have to call in the morning for the details.
    This should have been a dischargeable debt but since I didn't know about it I didn't have it listed. can it still be discharged or do I have to have my case reopened?

    I would think you would have to reopen your case, is it worth the additional cost, the waiting and whatnot compared to the debt you sopposedly owe?

    Maybe you can set up a payment plan with them?

    I just got through with my BK, and I owe the IRS $6000 from 2006, but of course I wouldn't of been able to discharge them, so I setup a payment plan with them to payback $100 a month (with the intention of paying back more when I can).

      I don't even know the full story yet and where the extra $1000+ came from. I'll call them in the morning and find out. Then I will fax a copy of my discharge and see if that takes care of it.

        Well if you didn't include them on your BK, than that discharge would be useless to them ? Interest and penalites probably have accrued since 2002. Make sure you get them to give you full details on where this debt is coming from and how they came up with such a large amount - details! By the way, I did read somewhere that the IRS do use outside collection agencys to try and collect a debt, but also they can garnish your wages in a heartbeat, so if your wages haven't been garnished by now, make sure this is a legitimate debt.
