    Oh the irony :(

    We are surrenduring our property (which had to become a rental in order to TRY to make the mortgage payment). The first renters trashed the place and left us hanging for $2300! The second renters just stiffed us for $1500 and when we went to the house today they took the dishwasher, stove AND air conditioner. I had planned on bringing the stove to the house we're living in because it is MUCH nicer, guess they thought so too.

    We filed a police report, but they told us without serial numbers there's not going to be much we can do about it, can't prove it's ours.

    Does anyone know if we try to garnish their wages whether it'll go to the Trustee anyway? I realize we have to get a judgement first, but I doubt it'll be a problem getting that. But if garnishing their wages is just going to delay the bankruptcy, I may just forego it and write them a letter and tell them I hope they burn in hell!

    11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

      The Trustee is probably going to ask about the rental income. Not much you can do for the missing items as the police said without serial numbers, nothing for them to track with . Most likely at this juncture if you tried to get a judgment against them then it would go to the trustee estate. Did you list these people on your forms as owing you money? If so the Trustee might go after them. If not you probably need to amend that portion.

        They didn't owe us when we filed. It's only been since we filed that things went South. Do you think we should still amend?

          First off, did you list the rental agreements under "executory contracts" on your BK petition. (if you did not, you should have). Odds are the trustee is not going to care...most trustees do not "accept" leases on residential rental income since there is usually very little profit and they don't want the headache of managing the property, thus, they do nothing and after 60 days from the date you file, the lease is considered rejected by the BK estate.

          I don't think you need to amend anything.

            Yep, it was all listed, so they know about it, it's just that when we filed there weren't any arrears from the renter, at least I don't think there was. They may been a week late or something, but that would have been it. I plan on calling the attorney on Monday morning, but was curious if anyone had dealt with anything similar.
