I have my 341 on next Wednesday (dreading that). And I have a question about pref payments. I listed a payment of $1400 to my mother on my petition. Here is why:
About 10 months ago I was switching jobs and needed a transcript from the college where I got my masters degree. I still owed the school money for fees. I had a check coming that would cover the fees, but I needed to pay them immediately. My mother paid the fees and I gave her $1400 when the check I was waiting on came about a week later.
1. Is this really a preferential payment? I asked my lawyer and he told me to list it just to be safe.
2. Is my mother going to have to pay this back to the trustee?
3. If she does, can I pay it?
