Will they believe me I sold most of my property?

    Hi Boscoe!
    I found a good attorney who was very understanding....and helped calm me down. He told me not to worry about my personal property since most of the sales were over a year ago, I am currently selling my cars, and keeping a good papertrail of the money, My most valuable vehicle is right at the exemption amount for colorado.(we pulled it up on kbb.com)..so the attorney said we are ok. Of the three attorneys, 1 seemed very unpersonable, one friendly but almost dishonest, (told me to put my vehicles on blocks and take off the hoods and take pictures and he would try to claim 100 value on them)...and then the final which was very professional and is very accessible, he calls me right back, and isnt sick of all my questions.

    im still very nervous tho....it feels so weird not paying my bills, ( ive paid my retainer), i just started getting calls from creditors, and at this point just trying to sell off a couple of cars. i have one buyer for the truck which should have the money in 3 weeks, and another buyer for another car, and the wrecked car...my attorney said if i cant sell it, he will with photos see if we can work a deal since its a 3k car with about 3500 repair bill...and maybe they wont even care about that car.....

      Hi!
      The lookback is usually only a year, and they are looking for big money items like RV's, motorcycles, boats, cars etc. Also large screen brand name LCD and plasma TVS.
      Smaller items of interest are things like guns, game systems like Wii and xbox, ipods, and old collections.
      The lawyer read off the items of interest...its was those above items...we owned none..lol!!
      Trustees are looking to make BIG bucks. People like you and I plus most here are probably considered pitifull... They probably are living in $600,000 plus homes driving beamers and Lexus. BECAUSE of those Rv's, motorcycles.....
      Everything will be okay! I know its easier said than done...but try to relax, go step by step.

        We own an antiques & collectibles business and for the past 3 years sold all of our really expensive items at wholesale just so we could pay our monthly living expenses. When the attorney asked for a list of everything valued at over $200 we told him what we'd been doing and he didn't seem to care one iota. We gave him the list and he said there wasn't enough to worry about and said it's ours to do what we want with, so just BE HONEST, I think that's what helped us.

          yeah, budman, it is weird thinking about not paying bills after so many years of faithful payments.

          But think of this as a temporary situation and before you know it, you will be discharged and then can go back to paying all your bills again.

          I don't even like the term 'bankruptcy', as if you ask 9 of 10 people on the stree and they think it means 'give up everything you own, rent a crime ridden flea-bag apt in a bad neighborhood, eat and sit on old lawn furniture and have 0 money to your name'.

          It should be called "Financial Reorganization". I really think the name itself keeps alot more people from filing. Those are the hurting ones, the people with a mountain of debt, just barely getting by that flat out refuse to file.

            I really think I should have done this a long time ago...those cc companies have been making a ton of money on me off the interest...my balances were brought down from me paying them down, and they lowered my limit so i would get overlimit fees, I havent charged anything in about 6 months, and i always paid my bills on time and at least the minimum amount, but since i got injured and got on disability, lost my job, and got a job at half the pay, i realized i can barely pay my bills, but i cant eat or have money for daily necessities which forced my hand to do this. I know its stressful....I was out of work for 7 months and used my charge cards to live off of and exhausted my life savings to pay my bills, i got another job with much lower pay and realized with no savings there is no way i can dig myself out of this. before filing i pulled my credit report and it was really good. After this bankruptcy is over ill look for another job after all the dust clear and i get off the radar. Getting a job at 28k a year which helped me pass the means test i guess is a blessing in disquise as opposed to the 60k a year job i used to have. When i got divorced a couple of years ago, i quit claimed my home to my parents. So that was also a good thing for me.
            I am just looking forward to less stress and enjoying life this has effected my physically and mentally. I appreciate all the support and advice. I felt like dirt but i realize that many people have had to go through this...and i am not alone.

              also i havent filed quite yet, ive got a retainer on my attorney, but waiting till i sell my cars before filing. I am in the process of filling out his packet of papers, I have all my tax transcripts and bank statements and creditor information, and paystubs and the whole nine yards.

                Just focus on the next bk task at hand....you could get overwhelmed if you try to think of everything right now. I know I did -the most stressful part is to get all the files together.

                But after you are done, it really helps you understand where you are financially and how important being organized is...

                I know it sounds like a line, but one day at a time. Worry about tomorrow then, and next week, well, next week.

                  Yep, best thing is to take one day at a time and watch the light at the end of the tunnel get brighter and brighter each day.

                  The relief you will feel when all this is over will be "fantastic" since you have been fighting this so long now.

                  Take each day as it comes, smile and remember there is a "fresh start" waiting for you in the end....

                    Thanks everybody!!! after getting over this. i need to start taking care of my self physcially and mentally....my health has gone down. stress....loss of job and a bunch of bad things happening ive let take a toll me..and i need to get better...and quick.
