    Timeline start to finish on CH7

    Hi all I was wondering what is the time line from the day you file to the day it is discharged??? And once it is discharged can you start to get new credit to try and rebuild???
    Converted to Chp 7 in July 341 AUG 3rd Went well!!!
    Trustee Paid Off Looking At Discharge!!! Might Be A Good After all!
    Discharge Date 10/02/09 Counting the days down

    in the handout I got from a lawyer today, it says about 6 months

      If a 7 - about a month after you file you will have the 341 hearing, also called the creditors' hearing. Hardly any creditor ever shows up. Trustee will ask you if John Doe, or whatever is your real name. Show him/her your driver's license, and SS card. 5 minute thing.
      30 or so days after this "hearing" - and if you really are assettless,
      the trstee will send out a notice of no assetts.
      The court/trustee gives creditors 60 days from the day of the 341 hearing to file an objection of their debt being discharged. If they don't file an objection by the 60th day, you're home free, and should get your discharg papers within a few days.
      I filed mine July 9, 2004.
      341 hearing was on August 16.
      Received "no assetts" document sometime around middle of September.
      Creditors had until October 16 to file objection. No one did.
      Received my discharge papers on the day that the Boston Red Sox won the 2004 World Series. Party time!!

        Generally speaking, from the day you file,........ Your FIRST scheduled 341 is about 30-45 days from filing. But it can be longer.

        When the rush hit in 2005, the Courts were so overwhelmed that some filers didn't have their 341 until months later.

        We have friends who filed this summer and the BK business sure is up in Michigan. 2 months from the day they filed to their 341. So time line there depends on how busy the Court is where you'll file.

        Then it's 60 days from the 341 to Discharge. Barring any Extensions that may be filed.

        That's the bulk of what's really, really most important to the bulk of filers.

        Closing can come any time from the day of Discharge to some time in the future.

        Our case was 7.5 months from filing to Closing.
        Filed Ch 7 - 09/06
        Discharged - 12/2006
        Officially Declared No Asset - 03/2007
        Closed - 04/2007

          We filed on June 4th and got Discharged on October 15th (would have been longer, but I called and they posted it THAT day! ) So, ours took about 4.5 months, BUT to prepare to get ready to file was an additional 4 months, so it took us 8.5 months from the time we retained our attorney to the date of discharge.
