    Need Help-ASAP-- Payday loan

    I just got a phone call from a collection agency stating that Access Processing is going to sue me b/c I defaulted on a payday loan with them thru BOA and that they now are reporting the money has stolen and that it is a Federal offense.

    I called my attorney and she is not in the office right now.

    I have not heard from Access processing since October 2005, now after they have been notifed from the courts about my bankruptcy they do this crap. Can they do anything? Or is the collection agency blowing smoke?

    Defaulting on a loan is not theft - they are trying to scare you. If you've actually filed the BK, they may be violating the automatic stay and may end up owing you money!

      I'd have them tell you that exact same story in writing and then burn them.

        The collection agency is as full of #### as a Christmas turkey.
        The very first post I made on this site dealt with payday loans. In a nutshell, when two parties exchange a check that they both know is no good, it's an unsecured debt. not a bounced check.
        They are violating the automatic stay by contacting you.
