Does filing bk affect warranties on products included in bk?

For example: Our tv from Circuit City. Of course Chase wants it back, but they aren't gonna come and get it, and I will continue to ignore their letters requesting it back. But, if I have a warranty claim on my extended warranty, will Circuit City still honor it?

Another example: Lowes. We bought carpet from them, and they installed it also. We are having problems with the carpet, and they just came out to look at it. The carpet was paid for on a Lowes card. The balance was included in bankruptcy. So is the warranty still good?

I don't think there's any way that they could legally deny a warranty because you filed BK against their finance company... That's like buying a Ford car/truck, financing it through Ford Motor Credit, and filing bk on them (and exempting the car). You then have a mechanical problem and take it into the dealer. They couldn't deny your warranty claim because you filed bk on FMC.

That is an interesting question and a new twist (honestly, I never thought about it before).

I suppose you would have to turn to the warranty agreement to find out. I suspect that the standard "manufacturers" warranty would be unaffected since that warranty comes from the manufacturer and is unaffected by any financing (the "store" bought the item from the manufacturer already) and any service done under the manufacturer warranty would be unaffected because the store makes a claim directly on the warranty for payment...but any store extended warranty or service contract could be null if the item purchased is financed and you BK that contract. But I suspect you will find wording in the extended warranty agreement about the implications of a BK.
