    does anyone know where providian is based, it seems that when claiming the statute of limitations as a defense, they can choose either your state or theirs as a defense,whichever has a longer statute, am i correct? a collection agency is taking me to small claims on a old cc debt that i havent paid on since july of 2002, the state i obtained the card in and made my payments to(california) the state i currrently live (florida) and customer inquires to providian (texas) are all 4 years statutes, so what does their lawyer know that i am not aware of? and why is he pursuing this? also when asking for a debt validation, can i request paperwork showing HIS company has the right to collect,as a previous collection agency had this acct before him.and gave up on trying to collect.and if he got his paperwork from old collection agency then i can ask if the original collection agency had right to collect, do i bring both of these issues up at pretrial? thanks

    Many lawyers file these suits hoping you won't respond and they get a default judgment.
    There is actually a site dedicated to Florida residents that can help.



    It has a lot of Fl. caselaw and some lawyers hangout there.
