Hi all. I'm new here. My husband and I talked to a lawyer yesterday and she suggested waiting a few months to file since we've been using our CCs up until about 2 weeks ago and she said it looks better if you wait 90days. She did say to go ahead and stop paying them and anything else we plan to discharge. First, I want to ask if that sounds right. She said she didn't see any problem at all with us filing Ch 7. We may need to wait until April because I'm pregnant so we'll be a family of 4 instead of 3, but otherwise we pass the means test based on what we've given her so far.
Second question: We need to get a new vehicle because one of our cars just died unexpectedly and the repair cost is more than the replacement value of the entire car. So we are planning to discharge that one and give it back in the bk. Problem is, our other car is a 2wd truck and we REALLY need 4wd as we live in NH and we sometimes take 15mins just to get out of our DRIVEWAY with this truck. So we were thinking of going car shopping this weekend. We had planned to reaffirm the truck either way. So if we trade in the truck for a different vehicle with the intention of reaffirming it, will it cause any problems?? I did ask the lawyer if if would cause problems for us to get another car in general before we file to replace the dead car and she said she didn't see why it would as long as we don't try to discharge whatever loan we might take for it.
