I just found this site. If anything it makes me feel better that I am not the only person who spends most waking hours freaked out about creditors and thier relentless phone calls ( thank god for caller id). Anyhow, the wage attachment my husband received at worked was the final straw for me. I called a BK attorney today and I guess I just need to know what we are in for. Our debt is 100% credit cards to the tune of about 40-50,000.00.We have tried to make the payments and have fallen seriously behind. They won't even accept "good faith payments" anymore. Yes we do have a large 1st mortgage payment and a smaller 2nd one.We are considering refinacing or home equity loan but I fear our his score is so low that we can't. We do own our two cars and a 4 motorcycles, two are registered the rest are dirt bikes. My concern is that I want to get out from under this debt but not have to loose the cars and bikes or "gulp" the house.Idealistic I know but they are pretty much all we have. We haven't bought anything on credit in three years. Mostly due to the fact that the credit card comp's shut them down. Also, can they touch my husbands 401k? Please, any answers would be so helpful.

Thanks for the response. i just came from a BK lawyer. She was helpful in most areas and i have probably clicked on almost every thread in this forum. My main concern is the fact that I want to avoid losing any of our tangible assets ie; vehicles, furniture ( we still owe money on) she said proably not. Just looking for anyone that has gone through a "simple" bankruptcy and came out somewhat unscathed. She also suggested that I stop paying everyone. I don't quite get that. What if we don't qualify and this doesn't go thru. Then I am really in trouble.

Contact you another lawyer, get 2nd opinion to ease your mind. Just make sure all your ducks are in a row, be honest and upfront with your attorney.

Thanks again. Yeah, I am going to contact another one. I didn't feel all that comfortable with her.I am a wreck in the mean time. I am just so afraid that things are going to tumble down all at once. Just a side note; does anyone think it's a little ironic that BK lawyers need at least 1200.00 up front? Jeez, if I had the 1200.00 I would be able to pay some of my relentless bill collectors. Thanks again for the good thoughts though. Very much appreciated.

Most attorneys will not file you papers until they are paid in FULL - yet sometimes you can find one that will put you on a payment plan that has to be paid in full before 341 meeting.
If you wanted to "go on vacaton" - you'd find the money...
If you really need to claim BK - sell something to raise the money to do it...............OTHERWISE you'll never get things straightened out and just get further in the hole.
Bk is stressfull - many of us have been there and done it!!
Stay calm, listen to your lawyer (get the advice of 2 - consultations are free) and pick a lawyer your comforable with and answers your questions.
You can file yourself rather cheaply - but best know what you are doing!!
