    Disclosing all bank accounts

    Hi All, I'm putting together all my paperwork to deliver to my attorney and I have another question.

    I have separated from my husband but we have a joint savings account. It's really his account and I don't think he will willingly give me previous bank statements for the account.

    Will the trustee find out about all accounts that I'm on? Should I go behind my husband's back and get the bank statements on my own?

    Since it's a joint account, you need to let your attorney know about it and have it properly disclosed in your bankruptcy petition. It's a really bad idea to hope the trustee won't find out. Too much is at stake.

    Since you are on the account, I think you have every right to walk into the bank and ask for the bank statements on your own. That way you avoid a fight that possibly won't get you anywhere. Many banks are computerized enough that your local branch might be able to print out the months you need on the spot without ordering them.

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

      thanks for responding

      i sent him an email asking for them. if he doesn't agree to mail them to me, i'll request them on my own. i'm sure he wants to remove me from the account now, but he's on the west coast and i'm on the east coast. i did warn him not to have any large sums in that account since my name was on it.

        He may not want to disclose it, but he will have no choice since it is a joint account..... basically to the Courts, half of it belongs to you. They can freeze half of it if they desire too.
