The military over paid me and has the right to collect my income tax return. My question is, can they collect it year after year until the debt is paid in full? If not, which years are they able to collect? The debt was incurred in 2001, but they discovered it in late 2007. Shouldn't they just be asking me to pay them whatever my 2001 return was (it was smaller)? Does my 2003 Chapter 7 no asset bankruptcy get me out of this?

The military can collect the debt for as long as the debt is valid. I am assuming the overpayment was a wage ovepayment? The fact that they are capturing your refund to make the payments is irrelevant. I would do further research, but my gut tells me it should be a non-priority, unsecured dischargeable debt.

Did you not know they overpaid you when they did? I know when I was in and I was overpaid, I knew it and didn't spend the money because I knew it would be a matter of time before they would want their money back.
Normally they catch overpayment's quick, never heard of them taking 6 yrs to discover it. And they can take the returns as long as they need to in order to get the money back they overpaid you.
