    Just what I needed UGH!

    Hi My dog as I said before is 16 years old, health is failing she sleeps most of the day and is up all night. Well last night was no exception. I was sound asleep this afternoon when the mailman came, I did not hear him ring the doorbell. Anyways I just went to the mailbox and I have a receipt to pick up a certified letter. Could I be getting sued already cards are not even 2 months late yet.... UGH! WE were hoping to wait till December to file....

    I need a nap!

    I'd be pretty surprised if your being sued already. Usually it's at least 6 months before they start the legal process

        I had Citifinacial file a lawsuite against me after THREE missed payments.. I filed Chapter 13 a week before my court appearance..

          Oddly enough, I too received a couple of certified letters today (wasn't home when the postman came by).

          Didn't listed the sender on the slip though (had a ? in the Sender's field).

          If you are sued, is typically via certified letter or does the Sheriff deliver it to you?

            By sender it just has a zipcode of 60133. This really really sucks!

              Guess we'll both find out tomorrow

              Don't get too stressed out about it....I suppose it could also be the creditor just sending a certified letter to make it look a little more threatening, but not necessarily a lawsuit

                  Mom2one: You may need to reconsider getting your bk sooner or going pro se. You see, when you file bk it tolls suits of all kinds. In other words if you are suing, it is frozen, if you have a suit against you, it is frozen and it stops further suits from being filed. You really don’t want to get a Judgment as that is more difficult and can be avoided. Start it soon if you are intending to bk at all. It starts to be a relief from dunning phone calls as well. They cannot call you, you just refer them to your lawyer or give them the case number. If you can afford it, the Chapter 7 book can be downloaded for only 17 bucks in pdf form from Nolo.com. It has all the forms and all the instructions. To file yourself I think it is about 200 bucks to file. ‘Hub

                    We got several certified letters from one of our creditors. They were all just letters reminding us we were behind on our behind and needed to pay immediately (as if we had forgotten). There was one day we received 3 certified letters from the same creditor, each certified letter had the EXACT letter inside. Hopefully that eases your fears for the night. I hope that's all it is!

                      OH, I forgot to say...I'm very sorry your dog is not doing well! It's very sad when their health starts to fail! Take Care!

                        Thanks, I am hoping that is all that it is as well. We just stopped paying the cards in May jeez! LOL. Thanks for the good wishes for my dog, I have a feeling the end will be soon. She is 16.

                          Hi Mom2one: my very best for your wonderful dog. I know the pain of losing a beloved pet.

                          On the letters, this particular scenario may not apply but in case it does, here goes: We got one the other day addressed in my father's name, who has been dead since 1962. It came to a physical mailbox that at our gate, but we do NOT use this for our mail, we use a P. O. Box instead for all our important mail. Now upon investigating this, we found that this is for a telephone number that is long dead and has been paid off and closed for more than 4 years. The number was in my Dad's name, sort-of. It actually was listed as Mrs. XXXXX XXXXXX for security reasons, but again as I say, it is a long ago finished deal.

                          It seems that there are collections agencies out there that harvest old, closed accounts, then send out mailings to see what they might be able to bilk out of unsuspecting consumers. A fishing (phishing?) scheme, as it were?

                          We haven't done it yet, but we will be sending a copy of my father's death certificate......

                            Try to wait til you get it to worry. It might just be a standard certified letter saying they'll sue you if you do not respond in so many days. For it to be an actual suit the papers would most likely be delivered by law enforcement. (As mine were before my filing).
                            May 31st, 2007: Petition Filed by my lawyer
                            July 2nd, 2007: 341 Meeting Held
                            September 4th, 2007: Discharged and Closed.

                              I'm just upset as we were planning on waiting until December to file. We need to save for an attorney and wait for a big pay in May to drop off. UGH everyone kept telling us we had enough time!!!
