      It depends sb, if at any time one spouse has used the card or even paid on the card of another in a community property state it is generally best to have both file in many cases, however in Brookamy's case MN is not a community property state so that concern is removed .

      Brook I notice you didn't list any medical insurance, do you have some through work etc that you might have forgotten to list? Do you donate to charity (many jurisdictions allow up to 10% donation)?

      Just make sure to take everything you can for the lawyer to look over and figure out what is best

        My health insurance is paid completely through work. Hopefully we get to add medical bills to our means test though? I need to figure out clothing, entertainment, car maintence, ect...


        I'm feeling a little better. I got most of my stuff ready for the meeting with our attorney. Need to my husbands info together as well.

            I'm hoping, of course, to be able to file chapter 7. I guess I'll be relieved to get 13 though too.

            Will I be able to keep my house? My car?

              So long as your payment is current on the filing date and you stay current in a Chapter 7 you should be able to keep them. It really depends largely on how much equity you have in them and local exemptions, you should ask the lawyer about it and options.

                We financed my wedding ring through Wells Fargo credit at the jewelry store. Can I keep paying that so I don't lose my ring? If I include it in the BK, do I lose it?

                  You legally have to list all debts in the petition, I assume the loan is secured by the ring, if so you could seek to reaffirm the loan. Jewelry keeps its value better than electronics/furniture so it is possible they might object to the discharge of the debt for the ring. This is something you should check with your lawyer about especially if the ring has any equity in it.

                    I don't think it has any real equity in it. I'm hoping to reaffirm the loan....which I thinks mean keep it current right? I'll keep paying the ring payment then...

                      Yes you should keep paying it. Advise the lawyer about it and see what he says as well .
