      my husband and I are thinking of filing (we have an appointment on Tuesday) and I'm extremely scared. I feel like a failure. A few people have told us that if we decide to file, we should go and max out any credit cards that arent already before we see the lawyer. I feel like this is wrong and we could get in trouble for this. I'm so scared and I dont know what to tell my family.
      any suggestions?

          Maxing out cc before filing is a NO< NO>
          You will have to pay it all back, plus it can cause your case to be dismissed. THEN bankruptcy will no longer be available to you!!!
          Read the "writing" on the wall....

          There's no "shame" in filing, but trying to "beat the system" will cause you a lot of grief down the road...

            I filed on Wednesday. Now it is Friday and I 'think' I am glad I filed. I am focused on getting my schedules and Chapter 13 plan done. I have been researching what the Trustee here wants. She is a really picky woman.

            I am going to get the preliminary work done and then I am going to find an attorney that will take my case from the 341 through confirmation. I could handle it to confirmation but my nerves are shot from stress and that slightest thing that might seem routine to the Trustee's office or an attorney would blow up in my face like Mt. Vesuvius with Pompeii.

            I can't believe I used to work as a bankruptcy paralegal.

              Max out the cards just before you file? What kind of damned fools are counseling you. Toss them aside, they are absolute imbeciles. It is called fraud and your case would either be thrown out or you would at least repay it all. The Trustee would consider you "fresh meat" and rightfully so. Don't do it, you will pay a severe consequence.

                Just curious. By some chance did any of these "few people" you know ever max out any credit and file for bk or are they just talking out their backsides? It's certainly wrong and stupid to do this, but I'm curious to know if these people actually did it and were granted a discharge. I doubt they would get discharged since this is what the courts and cc companies look for.
