    How Sweet It Is

    I filed on 8/1.

    Today, I got a letter from the laywers from HSBC which was a copy of a request to the court to dismiss the judgment they have against me. (yeah, it's without predudice, but if all goes according to plan this shouldn't matter.)

    Does anyone know if that will expunge the judgment or will I have to petition for that at a later date? I'm not concerned right now. I'm just so damn glad that garnishment proceedings never commenced I could just dance like nobody's watching!

    And the phone, oh the phone. Oh the lovely phone. No calls, well I had one on the 7th and is sounded like a new collection agency as I did not recognize the shpeil, but it was probably made in the interim between filing and notification. I can plug my phone back in when I want to...but I still don't always want to.

    I'm still scared cause the 341 is two weeks from Thursday but a tremendous burden is already off my shoulders. I now feel the relief I didn't feel immediately upon filing.

    I wish the same for all.

    Congratulations!!! I think, though am not sure, that if the judgement is dismissed, then it will just go away. I hope so. Anyway, I'm sure someone else with more experience in this matter will chime in. Good luck!!!

        How awesome! I have no wisdom to share, only happiness that you got past this hurdle! I hear HSBC is a PITA to deal with, congrats on that.

            Money judgments are discharged in bankruptcy with very few exceptions. If they weren't, you would get sued during Chapter 13 while the unpaid debt still exists. The point is moot post-Chapter 7, when the debt no longer exists.

                  Yep, I know but I was hoping there was a difference between "discharged" and "dismissed"?????

                    I'd take the paperwork by your lawyer. If you file pro se you most likely want to amend your forms and include the case # in your paperwork. You could also call the court that is listed on it and inform them of the bankruptcy filing.
                    May 31st, 2007: Petition Filed by my lawyer
                    July 2nd, 2007: 341 Meeting Held
                    September 4th, 2007: Discharged and Closed.

                        Well, Poop. I knew it was too good to be true. I looked up my case on the superior court website and a reject sheet for dismissal was sent to the HSBC lawyers because a judgment had already been entered.

                        I thought it was odd when I got the letter, but I also thought, hey, what do I know?

                          I'm so sorry you got bad news. Still, if this judgment is included in your filing, the Automatic Stay should stop any action, until you are discharged and then it should go away.
