ya may of 2009 is a 3 payperiod for myself and my wife and that would hurt us. So i understand you situation. Too bad you could not have planned for it sooner.
I would then file it. The worst that can happen is in a 7 they object and you try to settle for less, or in a 13 it gets tied in your payment plan.
