    Default Judgment

    Typically- how long after a default judgment- can a creditor's atty garnish wages? In my case, the arbitration award they were granted is being requested to be turned into a judgment - which will happen. Or is there not a 'typical" time? I am hoping two weeks, at least. Thanks.

    I believe you get 20 calendar days to respond. That is once you get notified, you have 20 days to respond. Then they respond to your response. Every tit for tat that the two of you do extends the time. If you DON'T respond, then they get their judgment that much quicker, and they then start the process of garnishment.

    Now, we never have gotten that far in the process, other than with the IRS, so I have no direct experience with a creditor garnishing wages. Other members who do, will chime in I am sure.

      Phew- I found the Ohio Law-Revised Code 2716.02. I think my 28th day after the arb award is turned into a judgment is 9/18. Shortly after- I have to get a certified letter-and 15 days after the date of that letter, they can start garnishment. So at least I'll know, which is my major concern. I'll file within that time.

        I was able to follow my default judgment online at the local superior court website. Don't know if you can do that too, but if you can, it might help in seeing if the plantiff has filed any type of writ.

          My advice for any of this type of situation is to ALWAYS get Certified Mail, Return Receipt. It costs around $5.00 or a little more, and is well worth the mental satisfaction of having that little green card with a signature on it in your BK file.
