I have a credit card that was charged off and I was sued. The CC company got a default judgment.
I do not work, but my husband does. We (stupidly) had a joint account that was seized. All of the funds came from his paycheck, which can be easily proven (the balance was $0 and then he cashed and deposited his paycheck).
The entire balance was seized, but I can't find any information specifcially for my state (Colorado, NOT a community property state) that can tell me if he has a claim to half of that amount or not. I've even read that some states will say that 75% of that is exempt because it was wages, but again, I can't tell if that applies to this account.
We've gotten an account only in DH's name and will avoid the problem in the future, but I'd like to get even half of that money back if possible...I'm just not sure of where to look or how to proceed. Can anyone help?
