    When to see attorney

    I would like to see if I can file chapter 7 but have recently used credit card. I have a house which I plan to keep making mortgage payments on and a car which is paid for that I would like to keep. I have credit card debt which I am struggling to pay and cannot keep current along with insurance, food and heat and utilities. Do I have to wait X time before I see lawyer for advice?

    No, you can see an atty at any time, and even retain one. He or she, however, may suggest waiting XX amount of days or even months before filing though.

      Also depends on the size/reason of the cc usage. Last time I used my cc was a week or so before filing for a major $750 car repair. Trustee at my 341 hearing didn't care, and surprisingly the creditor did not object as to the dischargeabilty. Of course this was in 2004 - old laws.
