Which state?

Hi all I have been living in AR for 9 months. Before that I lived in MO for 2 years. Before that I lived in AR for 2 years. (I bounced back and forth a lot.)

I saw the part in BK where you have to reside in a state for 40 months to use that states exemptions. But when I read up on MO it says I have to live in that state for 91 days before I can use MO exemptions.

Well I have not lived there for 9 months. So Which state do I get to use?

I have a house in both states. I reside in AR and my job is in AR. The house in MO is about to go into foreclosure. If any of that helps.

Thanks for your reply. It dosen't confuse me. But I am bummed that I have to use MO. As they do not allow for the Federal exemptions like AR does. Plus if I did not use the Fed I was hoping to be able to use AR's homestead exemp. Which if I understand it right, the house is off limits no matter what as long as it fits in their requirements for property size. Which we do.

LOL, Yep it was MO for 20 years.

Oh well, maybe I will just let them garnish my wages for the next 2.5 years until I qualify. Too bad I can't use bankruptcy wage garnishment for that. Cause in MO 90% of Head of household income is exempt and I have to pay alimony so they would get NOTHING!
In AR it is 25%, bummer for me.
