Hi everyone. Im new to this and ive been searching the posts for thoughts on this but thought i should post while looking. So please forgive me if this has been covered before.
I live in ohio and work in the auto industry. I dont make ford wages though.
My divorce was final 9 months ago and I let her keep the house and everything in it. Didnt want the memories.
Shes supposed to refinance and pay me $2500 for the house which Im going to forgive if i can file ch 7.
We struggled for a long time before the divorce. I was laid off 2 years ago for 6 months. Then last Christmas I got 2weeks off for being 2 minutes late to work which cost me $1200+. Then we filed jointly to lower what we owed in taxes and i paid because she didnt have the money. The stimulus money came very late so paying the taxes set me back. ...late payments and penalties etc. I was laid off again 3 months ago. I pay child support but cover 90+% of his care and hes with me every day. I also have put food into her house for the kids, bought her son shoes and clothes and drive them where they need to go because their moms gone alot or wont. When the divorce was final I paid off her utilities and then 175 for her to transfer a utility into her name. During our separation she still had my paycheck and wasnt paying bills. So when she asked for a divorce i came back (long story) and had to pay another 500 for bills. So about $3000 of my money vanished.
my son needs the next set of braces and Ill have to pay it all myself.
Early this year I moved in with my mom in order to get back on my feet emotionally and financially. After I did and was on my way I was laid off. I figured 6 months there would allow me to put about 6k on my credit cards but it didnt work out that way.
With the auto industry a mess im worried about losing my job which would make living and paying my cc impossible. So i talked to a lawyer and he said I could file chapter 7.
ive had some late payments which pushed my intrest rates up, had a utility put in collections even though they didnt tell me i owed anymore. Im constantly behind on my cell bill but I cant cancel it and pay the penalty. Ive been late with my care payment for 6 months and paying late charges. I only have money because I borrowed $1100 from family in the summer and was hit by a drunk driver a month ago and settled for 1200. Ive been making minimum payments mostly but ive been able to pay more at times.
Im below the median income for 2 laid off and working.
1) my bank account is a mess (confusing) and i have no receipts to back up my spending on food, gas, clothing etc. How would this affect me and do they look in detail at it if your below the median?
2) what red flags do they look for in your bank statments and credit cards.
3) If i had my own place i would be have under a 100 disposable. If my interest on two credit cards is 320 a month would that make a difference in my success?
my lawyer told me i have nothing to worry about but he hasnt looked at my paperwork yet. So im concerned if i file and hes wrong about me being ok ill be in worse shape than before.
