    Should we tell the CC companies we're filing?

    HI everyone! My husband and I are filing chapter 7. We have an appointment Jan 7, 2009 to start the paperwork going. MY question is.. we have credit card companies calling us like 50 times a day and now they've started calling my parents house 5 times a day looking for my husband and myself.. should we tell them that we are filing bankruptcy?? I don't know how this all works so I don't know if telling the CC companies before we file will hurt us or not??

    Any info would be great! I don't like that they call us so much but now they are draggin my family into this and I DON'T want that to happen!! This is our problem not theres.

    Tell them that you have retained council and give them you Atty's info.

    Also inform then they are to contact him/her regarding your cc acct.

    If they tell you that they need that in writing, counter that by telling them that under the Fair Debt Collections Act they are only allowed to call you twice a day, and are not to contact any other family members or contact you at work.

      Once you have retained your lawyer, you tell them just that.

      Usually, the phone calls stop rather quickly at that point.

        After you retain the lawyer you can tell them, I wouldn't mention it til then.
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
