    Did not list a creditor

    I have an attorney that I owe some money to, about $3000 or so.

    I forgot to list him.

    Do I now need to amend the petition or can I just leave him off. I plan on paying him at a later date.

    My attorney is back in town today but late this evening.

    I'd go ahead and amend. It only costs about $26.00 and you'll know you have your bases covered and not have to worry NOT listing him. You can always pay him after your dischage.

      Given the amount involved and the type of creditor, I'd spend the $26 and amend your petition to include him.

        Thank you, I will do that.

        My attorney is going to kill me, I have had so many changes but better safe than sorry.

        I will keep you all posted on my 341. I just printed out the "sticky" regarding 341 questions by the Trustee so i know what to expect.

        Now after I get my wife to take a Zanax, calm her down and go over the set of possible questions I think that we will be set.

        By the way, if we filed jointly am I allowed to answer for both of us or does she actually have to speak?

          Play it by ear. If the trustee asks her a direct question, then yes, she will need to answer. But it mostly is a bunch of yes or no answers.

            Thanks, I had hear that they asked questions such as how did you acquire your debt so I wanted to know if I could answer.

              Xanax..nice drug *nodnod* My doctor gave that to me when she noticed I was having some anxiety issues due to the bankruptcy. It helped me to sleep more than anything, but I still have plently left for those "just in case" moments.

              The last time I took one was back in November.

                Yes, both of us have Xanax and Lexipro prescriptions although we use them sparingly.

                Just getting the phone calls to stop was a major relief of stress.

                I did not mind them so much but it drove my poor wife to the brink. They used every trick in the book when speaking to her and she was really scared but now we see light at the end of the tunnel.
