    How do I handle GMAC?

    I'm surrendering a vehicle to GMAC in Ch 7. Just missed my first payment on 1/11/09 and of course they aren't going to call me for some time.

    If I'm ready to get this truck out of my driveway and cancel the insurance can I call them and request they come pick it up? Also, is this a good idea or a bad idea?

    The last thing that I've got to ask is can I get them to meet me somewhere or can I drop the car off at a dealership or something? I'd rather it be done and over on MY time than them surprising me while my family is over or something embarassing. LOL

    When I surrendered my vehicle, I just called the lender, spoke to the BK dept and made arrangements with them for pick up of the vehicle. I also did not want it picked up at my home or office, so we made pick up arrangements at a neutral place. The lender called a transport company (as the lender is in Tenn and I'm in FL) and the transport company came exactly as planned.

    It is just a business arrangement - call your lender to make arrangements for a time and place convenient for you.

      We are in the process of filling. We called Citizens Bank and told them we are surrendering our vehicle that was about 2 months ago and its still sitting at my FIL house. They did call the other day again and my hubby told them again we are filling and to call our lawyer. They then informed us they will keep calling until we are actually filed. They kept on asking my hubby if it was voluntary surrender and a bunch of other crap so he finally just said call my lawyer and they called again yesterday and left a message to call them back. Good luck hopefully you'll have an easier time.

        Excellent! I'm going to give them a call today and maybe arrange to have it picked up this coming Monday.

          I know all about the embarrassment thing. Here's our story.

          We filed Chapt 13 in Oct 05. By April or May of 06, we decided to let one of our vehicles go, even though we had originally planned to keep it. It wasn't running, and was going to cost almost 2K to fix. We were so strapped by our 13 payment at the time, there was no way we could afford to fix it, and it seemed silly to keep on paying a truck payment every month for a truck that wouldn't run.

          Anyways, we spoke to the bank, and they told us someone would come by to pick it up. Imagine our surprise when the person who showed up to pick it up was actually a guy we knew. I don't know who was more embarrased......us or him. He actually said when he got the order he was like "Oh Shi++". He felt so bad. We all ended up having a good laugh over it.

            I filed Chapter 7 on 11/20 and I am going to surrender my car, but I was expecting a notice from the court for Bank of America to request a Motion to Lift the Stay before they came to try and repo it. Well, they didn't have my account flagged as a bankruptcy account and one night I was asleep on the couch and I heard a knock at the door. Thinking it was a family member I just went and opened the door and walked away without really checking to see who it was. Lo and behold it was the repo man...and it was someone I knew. He was an old friend I used to work with. The funny thing about it to me was I rode with him when he first started repoing cars years ago and I can remember then thinking it would never happen to me. Now he's a manager at the repo company but decided to come pick my car up himself so that nobody would treat me badly! He didn't get to take it though. I gave him my atty's info....but I'm expecting them back someday.
