    Shakes..I know...

    Just got off the phone with both CC and Finance company..Surprisingly VERY nice AND friendly!

    But still I'm shaking..I've got a payment to the atty this pay period and the next for $454.50

    2 down...4 (I think) to go...fun...

    CALM DOWN - It's going to be okay, don't let all this "rattle your cage" .........
    Yes its nerve wrecking at first when you first think about it and then file. But later on you'll realize it was really all "ok"... in the end....
    Fear of the "unknown" is what unnerves us all......
    Read the post of others experiences.....most were simple, easy, quick bankruptcies, no problems..........almost painless...
    Afterwards it just clean up the credit reports and work towards a debt free future..........with good credit from then on...
    Got questions, please ask.........

      Minny, here's a beauty.

      I emailed the lawyer, that his files he sent for me to fill out, wouldn't work on my
      computer.

      No reply.

      I found out that one of my CC's hit my bank with a $200 check by phone (It had bounced once before). So I emailed and called him BEGGING him to NOT send in the check, I would cover the fees by the next pay period. The check hit yesterday.

      No reply.

      The check hit yesterday.


      I am meeting with a new attorney, I have been asked to bring in alot of info, none of which the previous lawyer asked for.

      So, when they call me and say "Well? Are you filing or not?" Can you possibly guess what I'll say?

        Yeah, if the attorney you are dealing with starts out "kind of uncomfortable" - best to look/discuss with another....

        Right now attorneys are very slow getting back to you....especially if you call every day. I only called mine once a week or every 2 weeks.... gave him 24 hrs to call back - then recalled. Usually he was very prompt at getting back to me.

        You need to "feel comfortable" with your attorney - he is handling your affairs - you need to be able to feel free to ask questions. Remember, you are paying him for a service - he is not paying you.

        I asked mine "why did I hire you ? - when problems came up regarding my title on my home...... he got his "*%" together then....

        I keep a very close eye on what my attorney "does" and "says".............. and I also remind him what he is responsible for.....

        Girl's gotta take care of herself these days...........

          I'll tell ya what, Minny....I wish to God I would have kept tabs on what my attorney was doing. I have been learning a whole lot, and the more I learn, the more I see that my case was not handled correctly at all. I went to my attorney because I needed to file BK, but more importantly because I was being sued by a creditor. Well, I had one whole month before my court date and I saw an attorney right away. He seemed to know what he was doing....even though his office was basically an old house converted into an office. It was really old, and there was no decoration or anything, and his office was a very tiny room with a desk and a couple chairs. Well, I didn't think it was a big deal. Just because he didn't have a huge, modern, down-town office didn't mean he wasn't a good attorney, right? I mean, he had a two page ad in the yellow pages...he must be pretty good, right? Anyway, he asked me a bunch of questions about my income, and my assets, and my household goods. Then he took my summons and kept it. He told me not to worry about appearing at the court date because they would send a suggestion of bankruptcy. He said as soon as I paid him, he would send the suggestion of bankruptcy to the court. Great! That seemed easy. I paid him the next day....895 bucks....and a few days later, I received my petition in the mail. I knew I needed to go through all my bills and make sure the petition was correct. No problem, I thought. I don't need to jump right on this and get it back to him right away. As long as the law suit is taken care of, I can take my time on over-looking this petition. Ha! What my oh so wonderful attorney DID NOT tell me was that they couldn't send a suggestion of bankruptcy UNTIL they had a BK case number, which they couldn't get UNTIL they filed my case, which they couldn't do UNTIL I returned my petition! He never told me that time was of the essence. If only he would have told me to return the petition within a couple days, I would have done so. Why in the world would I pay him and then mess up my own case? So, when I got the notice that a judgment has been entered against me, I took it to my attorney and asked him about it. Once again, he gave me bad advice. He said the bankruptcy would extinguish the judgment. Well, I believed him....like a fool. Imagine my surprise when I checked my credit report a few months ago and saw the judgment was still there, even after the BK was discharged. What could this be? This was supposed to be extinguished with the BK. So, now, I have a judgment on my credit report which I now have to worry about forever. Thanks a lot you great attorney.

          Now, my friend is going through the BK process. She saw an attorney last week and when she left his office, she had a folder full of paperwork. He gave her papers explaining every tiny detail about the BK process. And she had something which I found to be a surprise. She has a booklet she was to fill out. Basically, she has to fill out her own petition, which her attorney will then type up for her. Hmmmm, why is it that my attorney never gave me my own petition to fill out? Why is it that all I had to give him was some information and my credit report? I didn't have to fill out one single page. All I did was check over the petition he typed up for me. And there were about 10 of my creditiors missing from the petition he typed. I gave him a list of those creditors when I turned in my paperwork, but he probably didn't even add them.

          Basically, I would tell anyone to keep tabs on your attorney. And make sure you know what is going on, and what is supposed to be getting done. Don't go into it uneducated like I did....and don't take anyone's word for anything. Make sure they are doing what they say they are. Check and re-check your petition before you sign it...and if there are creditors missing, make sure you see the corrected petition before signing anything. You are supposed to be able to trust your attorney...but, alas, you can only trust yourself.

            Pays to double check that paperwork your signing. Most attorney's will have you fill out all the paperwork, then they go over it......

            WHATEVER YOU DO - "BE SURE" that you check your titles and liens against your property and homes to make sure they are true and correct. VERY IMPORTANT!!!!

            Lawyer only "know's" what you tell him.......be thorough......
            That "judgement" - you can dispute as included in bankruptcy and have it changed on your credit report. Check in the credit repair section of the forum....
