Fed Student Loans Sched. E or F?

    Good morning.

I'm preparing a pro se chap. 7 filing. I've consulted the NOLO book, and have a question it doesn't answer. I have 2 federal student loans--one Stafford loan from the Dept. of Ed., the other a Perkins handled through my school. I have been out of school for almost 10 years. I have continued to make payments since I know they will not be discharged.

So, what form should I list these loans on? Schedule E (unsecured priority) where most debts to the government go, or Sched. F with the rest of my unsecured debt? What did you do?

    Thank you.
I think of my bankruptcy less as "walking away" and more as "gnawing my leg off to get out of a trap".

Student loans are non-priority, so they go on Schedule F. I also found a pdf that lists trustee guidelines, and for Schedule E it says "Student loans are never priority debts, but are often listed on this schedule in error."

I wish I had a link to this, but I can't find it. Anyhow, it's really useful for us Pro Se folks.

      Thanks Joe!

Thanks for the info. I almost made that common mistake!

        Link to aforementioned statement

        I found it: www . dcba.org/brief/junissue/1998/art10698.htm

You must take out the spaces after the www and before the dcba

I did this to circumvent this board's dumb rule that I must have 11 posts before I can include a link.
