    If income increases during 60 day wait

    I'm filing chap 7 in late March (stuff needs to fall off first) and currently my only income is short term disab. which officially ends on March 2nd. Then soc. secur. disability kicks in on March 18th. I'm praying that my medical condition will improve enough for me to return to work since I make 3 times more than ssdi will get me. My question is, if the 341 comes around and then I'm in the 60 day waiting period for discharge, if I am able to go back to work will they look at that increase income and change me to a 13??

    Are you sure you will be getting Social Security Disability?

    If you are, you don't have to go bak to work right away.

      Yes Big John, I have the award letter stating the amount and first date of deposit. I have been fighting a cancer battle and this last episode made me go ahead and prepare in case I couldn't return to work. That's why I'm filing chap 7 to rid unsecure debt which was costing me about 1000.00 per month to carry.

      I'm comforted that I have prepared in case my symptoms don't improve but at the same time my work is going to "separate" me from employment if I can't get back by April 25th which is 38 weeks since I've been gone for treatment. so just wondering if I can try to work during that 60 day period, will it make them look twice at the income or should I just lay low and wait till final discharge before trying to go back??

        No, your financial picture as it were was frozen with the bk filing.
        What happens after that isn't the concern of the bk court.

          keepmine is right. for a chapter 7 it's a snapshot of your finances taken
          on the date of your filing. But if you're going to take that 200k job you might want to wait until after the 341 for you answer the question about your situaiton truthfully. The only thing you have to worry about after the 341 is winning the lottery or a big inheritence.
