    401(k) loans

    We plan on filing chapter 7 if we qualify.

    I have a 401(k) loan that is paid through a payroll deduction.

    It's a small loan, only for $1,000, that I took last fall to pay some bills.

    I am thinking I need to include it in my BK paperwork, but what happens then? I don't really want my employer getting a notice about it. Since it's my own money that is protected is it handled differently?

    I did a search and all I could find was stuff related to the means test and how you can't use the payment on there.

    Ask your HR person how that is handled. You don't need to give all the details.

      I had a 401k loan. My employer never knew anything about my filing. The monthly repayment was one of my monthly expenses. It was not an issue with the trustee and never questioned. The loan would have ended 12 months into my plan.
