I called my bk attorney this afternoon and I got "this phone number is not in service." What next? I've paid him $1,800 or there abouts...have to check my check register...that was for a 13 that I decided was not for me since I have no disposable income after rent/bills...so he pulled it before it went through...so it was not filed...he will not refund me anything is what my mom learned...can you believe that? Ok...so now, I'm going to have to drive over to his office and find out if he's still there...needless to say, I'm not his only client and I'm sure the rest of his clients are having a hernia on this one...any suggestions? aLL i WANT TO DO IS FILE A 7 LIKE i SHOULD!

You need to research this guy and find out what the deal is. Also, if he took off with your money and didn't give you any service for it, he owes you back at least part of it. You would have a case against him and you might even have an ethics complaint.

As for the fee, if he did everything but file your case, and he didn't file because you told him to hold off, you can probably kiss the fee good-bye as the attorney did roughly everything he contracted for. However, you should at least get back the filing fee.

Phone was back on this morning

and I talked to him. His secretary was out with a sick family member and the bill didn't get paid on time. He e-filed a 13 originally for me but that same day that I saw him, I called him & told him to retract it because after going home and getting sick to my stomach over the humiliating feelings I had when I had to talk about all my debt, I realized that I had no income left over to do a 13. But he's not giving any of it back...so this morning I told him, "7!!!!!" I haven't had hardly any cash in my checking since June and I told him, I'm ready to file.

A bankruptcy attorney who can't pay his bills on time? You should be at least a little concerned.
