    Bankruptcy Help Please read!

    Hey Everyone. I need to know if I should file bankuptcy, and I have lots of questions? I am twenty years old. I have about 10,000 dollars debt. The only thing i own is a car. And its 10 years old. Do I have to worry about a collection agency or company taking me to court? Can they take my car? Can they garnish my wages? If I file bankruptcy can they take my car? Should I file for bankruptcy? I do not have any credit to start with! So if i file bankruptcy, in about 5 years i could build my credit? I have a current lawyer bill I also owe for about 2000 they say if I do not pay they will take me to court. If I file bankruptcy before they take me to court, can they still take me to court. Many thanks in advance for input and advice!

    There is really not enough information in your post to answer your question.

    Are you currently employed?
    How much money have you made in the last 6 months?
    What state do you reside in?

    What is the nature of the 10k debt?
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I am currentyl unemployed, but looking for a new job. In the past 6 months I have been for the most part unemployed so probably made at most 1000. I reside in Pennsylvannia. I Owe 6000 in medical bills. 1000 credit card bill. 2500 lawyer bill.

          I own the car, I payed cash for it. I make no payments the kbb value is around 5000

            I believe Penna is a non-garnishment state, and the car would be exempt under federal exemptions. I think Penna is a tough state for debtors with judgements, so you might need to bk to protect the car rather than just ride out the storm.
            filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

              Don't file for bk over $10K just to protect a 10 year old car.
              Det isn't your problem. Your problem is no job. Focus on getting back on your feet. AT some point, you can address the debt issue but right now is bk is overkill.

                Yes! Do not screw up your life and your credit for the next 10 YEARS over $10k. As Keepmine says - you have an income problem, not a debt problem.

                  Also my dad is planning on buying me a house! And I think I should file bankruptcy before he buys the house and puts in my name so I have nothing to worry about. If I file bankruptcy and then when the case close I own a house wont that help my credit?

                    Honestly, you can't handle the credit you have now. You have no job. Good credit involves being able to pay your bills and support yourself. Until you can do that, bk is wasted.
