Filed chaper 7 in Fla the end of Dec 2004.
On May 30, received discharge and Pacer showed it as "no Assets" even though we own 2 vehicles out right. An asset valued at $10,000.00
On Aug 30. pacer showed that it had been changed to an asset case and gave my creditors 90 days to file claim.(All debts were unsecured credit cards) but we never received anything in writing.
At my 341 meeting all my trustee about my cars was "would you like to keep them" and I replied yes. Later she filed an objection to the values we had set on some things but US Trustee I guess overturned it.
We had an Attorney but he closed his office days after he filed our paper work (He had another attorney stand in for him at the 341)
My questions are:
1) We would like the opportunity to buy back our overages.Is this possible?
2) Being that the trustee objected to our values, how do they come up with the values?
3) We were slightly over on our personal exemptions so how will they decide what they want? Will they just show up one day to get what they want?
4) If no claims are filed by our creditors, will they still want to liquidate our assets and distribute the money between our creditors?
5) Should I call the Trustee and discuss all this with him?
6) Should we try to find another atty to help us out with all this? I here it will be very hard to find an atty to take over an existing bk case.
Pacer recently showed some other things I don't understand.
There was a interium report and a change of attorney address that shows up but it said no papers filed - will produce if requested? Anyone know what the interium report is?
HELP!!! Any ideas on what we should do?
