Just wondering if anyone has had success declaring a HELOC as an unsecured debt. We are attempting to incude it with the rest of cc debt in a chapter 13. We got the house appraised and it did come in as a little less than the first mortgage. I think the appraisal is fair.

Hi,
I'm going through this right now. Our 1st and 2nd are both held by Countrywide. At our confirmation hearing on 03/05/09 they got an ajournment until 05/07/09 claiming they needed to review the strip of the 2nd.
Which is quite funny since our 1st is $392,000 and in October they sent us a letter stateing our house was only worth $319,000 and not use the little room we had on the HELOC of $75,000.
So, now we have to wait two months for new confirmation hearing.
