    i was looking for someone who appreciated me, not what i can buy... i can build anything, fix anything mechanical, ride all day on my motorcycle thru the mountains, play a saxophone and have a college degree...im not a drunk and i dont do drugs...
    alas, when you get older, your options fade when you aint rich....

        Being stubborn is probably not the best solution. The creditors will eventually sue you for assets. (vehicles, property, furniture, etc...)

        Either way, having more than 1 vehicle may be considered excessive. I think you mentioned 2 bikes. If you own the vehicles outright then they have value if you sell them. If not, then you have monthly payments and insurance.

        You mentioned your day trips a few times a week:
        About $30 for gas and food. In a bankruptcy you go through the means test with certain standards for food and vehicles. Between the 2 you are allotted about $800-$1000 a month at the most. It sounds like your food and vehicle costs may be more than that.

        Taking care of the animals is very admirable but in a court of law they are probably not considered dependents. Buying things for the animals may be part of what got you into the debt in the 1st place. A trustee probably will not allow you to exempt the pet care costs.

        If you get the right lawyer you can try for a chapter 7. At the worst maybe you will have a ch 13 for a few hundred per month.

        Also, dating sites like Eharmony are expensive. I am single and easily spent $500-$1000 a year on dating sites / events. That is part of what got me into credit card problems.

          i with you on that... i was on eharmony for about 6 months...they sent me choices that i had nothing what-so-ever in common with...now im on one of the cheeper ones...
          i was spending a lot of money going on dinner dates, that was probably out of boredom..everyday, they send me some matches and i dont even open them.... in the words of clint eastwood, "a mans got to know his limitations"!..

          back to the bk, i havent completely ruled it out... i am going to delay it for a while and see what happens....

          if they want to put leins on my house, go for it...i can walk away from it, or if i file, they will strip them...i get my money in paper checks, so if they grab my bank account they will get lunch money...everything i have is financed to the max and they are welcome to it.. (just dont take my cats)....

          like i said, i was not that deep in debt before i got bad advice from a local lawyer and probably could have recovered in time..... then i let it slide into no return..
          shame on me for believing him..

          im in a pickle now with expenses and DMI as you have read.... its going to get worse... i was just informed that my health insurance premium is going to be reduced 250 per month and im getting a retirement pay raise..

          i am going to enjoy my motorcycles this summer, so that if i file and lose them, cie la vie!....

          life has some serious twist and in the big scheme of things, im not bad off.. what the hey, ernest hemmingway had 50 cats..

            filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

              ive been thinking about that... i havent paid my filing fee yet...

              if i could get a 7, i would be willing to eat the other lawyers fee and mark it up to experience....

              my last email read: to qualify for a 7, you must do two things... 1. you must pass the means test and you do...
              2. you must prove you have no excess DMI and you cant..

              whats scary, is what the first lawyer told me...i hope he does drugs, because its shameful if hes that "out of it" sober..he made it sound like i could keep all my stuff and might even get a check for my trouble.. just kidding...

                You are up to date on your house payments, vehicle and motorcycle payments right? I guess the CCs could put a lien on your house, but I don't think you have any intentions of selling it right? When your house payments increase, will you be able to afford the increase?

                Your mom is 88. Morbid question, but something to think about. When she passes, will you inherit any money? I ask this, because my dad will be 90 in Dec. and I will probably inherit quite a bit of money. We are having to wait until 9/30/09 to let some income drop off. Praying my sweet Dad lives to be at least 93 or 94 like his Mom and Dad.

                  i am current on everything but the CCs... im in kind of a catch 22 with the house....when the payments go up next year, i probably wont want to keep it and they probably wont refi... but then, they may want to deal verses getting a forclosure...who knows...

                  my mom has no money at all, but SS and a small pension from being a WWII veteran, as she was in the navy.. at her age, her mind is amazingly sharp....

                  if i didnt have these cats, i wouldnt mind living in a motorhome or the like when moms gone......other than theses CCs, im pretty much void of any responsibility...but you know, im assuming a lot.. none of us know if we will even be here next year or not...

                    You got that right. Crap, I almost lost my husband early Wednesday afternoon. In the ER they were turning the gurney upside down just to get the blood flowing to his Brain as his blood pressure was so low and he drove a Semi with a Trailer attached that morning 300 miles.

                    I haven't paid most of our credit cards since late 9/08 and gee the phone has stopped ringing. Received two collection notices regular mail. They all know we are filing, but just don't know when LOL!

                        Sir, I have read your story. If you only knew the options you have llikely never considered, you would not believe it... Hit me with a pm with a secondary email address and i will fill you in on a few things....

                        In regards to your BK, I'm sorta doing the same thing, as I am not seeing the big negative in waiting things out a bit more...with the way our government has run amok you just never know who will be the next people to get a bailout, so why file bk just yet? At least that is how I feel about it, based on a totality of the information I have recieved to this point. After the lawsuits start, I may feel differently, but I am going to make them work quite a bit before I just give up and go bk.

                          that is what im thinking... our government has truly run amok.. maybe we will get a bailout, but maybe debtors will be placed in the new FEMA prisons that lou dobbs couldnt explain..

                            It is true that misfortune can happen to just about anyone. Here you are with a great credit score, multiple homeowner and facing tough times. We should be grateful for the blessings we have.
