    Curious.....

    I was talking to some folks on another forum- and this one guy stated that he filed a chap 7 in one state, then filed another chap 7 in another state 3 years later. I told him that I was under the impression that you had to wait 6 years to file a 7 if you have done so before- that you could only file a 13 after a 7 within 6 years- he said, true, but they never found out he had filed previously because it was in another state. Is this B.S.? i find it hard to believe, but who knows......

    I also find that hard to believe, because Bankruptcy is a federal court issue, not a state court issue. Surely somebody checks social security numbers; seems to me the computer would find double filing.

        Strictly speaking, you can "file" as often as you like (within certain limits), but you can only receive a "discharge" in a chapter 7 once every 6 years (under the current, soon to be old, law).

        What this guy is saying is possible...but if anyone ever did find out, his discharge in his second bankruptcy would be revoked.
