My Ex. didnt pay child support for about 8 month in 2008 so his taxes were garnished to pay it ($2149). They hold tax money for 6 month to give him and his wife time to dispute it. NOW... my husband and i will be filing BK ch7 soon and i was wondering if they will take that money, it should be mailed to me in september.

Than money belongs to your child. I doubt they would take food out of his mouth. By the fact that you had to make up the deficiencey, could be a good excuse for reason of your bankruptcy. Ask your lawyer of course, but I don't think they can take money belonging to your child. 'HubIf I knew it all, would I be here??
