Quick question - my 341 is on the 15th of next month and my discharge is in January - will the trustee want my tax return this year? Just curious...

Very good question!
My 341 will probably be sometime in November or December (filed 10/6) and this will be the first year I'll ever be getting a refund...do they have the possibility of taking mine too? I've never gotten a refund due to my X-husband's income (divorced five years now...) but I just paid off the IRS for 2001-2004 for what I didn't pay on my alimony which ended last November. So I've been working since last November at my job and was hoping to see a little kickback in my tax refund come April 2006....?Filed Oct 2005discharged February 2007,Shapeless in the fire's glow, tell me if you think you know,

You did not say which chapter you filed under 7 or 13?
Yes the trustee can go after any tax refund you might get this coming year.
Are you filing pro se or with attorney??
Trustee will notify you at 341 if he is interested in your income tax refund...

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

I guess even if I get discharged before April? What would make them go after your return vs. not going after it?Filed Oct 2005discharged February 2007,Shapeless in the fire's glow, tell me if you think you know,
