    Question about side work...

I have a question about side work. We just filed Chapter 7, Sept. 29th. Our meeting with the trustee is Nov.7th. So, we are not very far into this.

My husband has been trying to get some work on the side to help make ends meet. He finally has a potential offer, but we don't know if he should take it . Can he do this since we filed? I mean, I know he can take the job. But can we use the money to help make ends meet? Or will we have to give the money to the trustee? It is only a one time job, and depending on how long it takes to do the job, it may be as little as $25, but could be as much as several hundred $'s .

I don't mind giving some to the trustee for our debts, but since everything is supposed to be discharged, I'd hate for my husband to work all of his spare time, taking time away from our family, if it will all go to old debt and not be allowed to use it for the present day living expenses. It's just that with gas prices and having had to come up with the attorney fees, we are not making it from paycheck to paycheck. We are having to sell our kids toys (things they've outgrown, but still...). Now we will have to resort to payday loans. I know that's just a fact of life. But I hate to have to spend money on those fees too, if my husband can accept this side work, and if we will be allowed to keep it and spend it on living expenses.

Does anyone know how this is viewed with chapter 7's?

    Thanks!

Anything you earn after you file is yours. I would suggest not messing with payday loans, that will get you in trouble.

It is best to wait till after discharge...
I wanted to work a parttime job - my lawyer said NO - don't rock the boat.....

My lawyer was afraid the parttime job would throw me into a Chapter 13 instead of 7.

If he does work the parttime job tell your lawyer it is a temp job and let him take it from there.

Probably won't be a problem since its temp......

I was under the same impression as Pink_amulet. Our attorney had said any money coming in over the next 180 days had to be reported and would probably be taken for the debts. But he said insurance money, gov refunds, inheritance.... He didn't specifically mention me working or DH working on the side. That's why I am here asking... So is working income different?

          Thanks.

I posted about the same time as Minny and missed her post. Thanks Minny! This would definitely be temporary, it is only a few days worth of work.... But I was concerned about the amount. If they broke it down over several months to a year, it wouldn't put us into a chpt 13, but if they only went by the one month?.... We are approx $400 in the negative every month, even after BK. We just do without a lot. So you can see how this job would help us out a lot.
