    Lawyer has not filed yet

    My husband and I meet with a Lawyer on OCt 4th and Paid him in full to file a ch 7 for us. He said he would file on the 11th or 12th. I checked Pacer on the 11th nothing so I called our Lawyer left him a message and E-mailed him. Checked pacer on the 12th still nothing left another message no return call or e-mail. Toady I Called and he answer the phone said he had not filed yet but was going to do it today he said he was very busy. I just checked pacer again still not filed. When I was on the phone with him I said we have only till Friday to file under the currernt law. He said dont worrie it will be filed. I am worried that he might not get us filed on time what do you think I should do.
    should I just wait and see or what? I feel he should of taken care of our filing right away befor taking on more cases.

      It may take a day to show on Pacer. Yesterday, I paid my installment fee and I saw the lady enter the info into Pacer. I held out til last night, checked Pacer (hoping to see that the trustee had signed off) and it didn't show my payment. Today, the payment was there.

      Also, attorneys can file electronically, up until Sun. I'd say call him tomorrow to confirm it was filed, ask for a case #. (You can check w/ the court in the morning first if you'd like.)
      Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        Lots of lawyers will wait till this weekend and file all their cases electronically. They know they have till Sunday nite.

        But double check and make sure that he did file on time and not messed you over....

              Boy that was close, I bet you burned pacer up, I would have, check pacer with one hand, lawyer on speed dial onthe other hand.
              I'll be watching, you may never know when or how, but I'll be there. I am there now....

                My Lawyer even e-mail me with a 341 meeting time and date it is around end of Nov. He told me not to panic but not all the paper work is filed just what needs to be now and that he will have it all in by the deadline. Thanks for your support.

                  I know that there will be a lot of electronic filings this weekend. Our local newspaper lists BK's every Sunday. On the 9th, they listed 65 (which I think was an all time high) Today, the 16th, there were 101 and that was only through October 4th.
                  As to not returning your calls, I realize how anxious you are, but I know from personal experience, that sometimes the only way to get things done ans say no phone messages or anything unless a family member is on his/her way to the hospital.
                  Lots of people have desperate needs right now. If your attorney has told you that you will be filed before the new law, then just try to relax and trust. My attorney was tying to get filed Wed. before sundown and the beginning of Yom Kippur. Didn't happen, but about 9:30 Thurs. evening I received an e-mail from her with the case number, name of the trustee and the date of the 341 meeting,,,Dec. 8th.
                  The only thing you can do right now is wait, so just try to find something to distract your mind and plan on your "new start" taking effect on Monday.
